Summary Dissolution (Divorce) With a Summary Dissolution there is no trial or hearing. You simply file a joint petition for divorce. The terms of divorce by Summary Dissolution are most often final. However, there are some instances when the divorce under a Summary Dissolution can be challenged. You will have to see a lawyer about this.
Correcting mistakes and unfairness in a Summary Dissolution proceeding can be expensive, time-consuming and difficult. It is very important for both of you to be honest, cooperative, and careful when preparing your Summary Dissolution.
Regular Dissolution (Divorce) If you don't think a Summary Dissolution is right for you, then you can file for a Regular Dissolution.
With a Regular Dissolution, a court hearing or trial is held. If either spouse is unhappy with the judge's final decision, it is possible to challenge that decision. This can be done by asking for a new trial. It is also possible to appeal the decision by taking the case to a higher court.
The Procedure You and your spouse must completely agree on the terms of the Divorce.
The procedure is carried out by preparing and filing a Joint Petition for Summary Dissolution, together with a Marital Settlement Agreement, with the County Clerk in your county. After a six-month waiting period (during which either of you can stop the process if you change your mind) you apply for and receive a final judgment of divorce.
After the 6-month waiting period, you submit the Request for Judgment, Judgment of Dissolution of Marriage and Notice of Entry of Judgment.
If you do not complete this final step, the divorce will not be final. Either party can stop the summary divorce by filing the Notice of Revocation of Petition for Summary Dissolution. This form is included but will need to be completed with a black or blue ink pen if you chose to use it.
